HEARING OFFICER ORDER
On February 26, 2009, a telephonic status conference was held. The Illinois
Environmental Protection Agency (Agency) did not appear. Discussions centered on the
February 5, 2009, Board order. In the order, the Board directed the petitioner and the
Agency to brief the issue of whether adjustment of a standard adopted in the Board’s
rules that also appears to be a statutory requirement is allowable. See order at 2.
The briefing schedule is as follows. Petitioner’s brief is due to be filed on or
before March 26, 2009. The Agency’s brief is due to be filed on or before April 23, 2009.
The petitioner’s reply, if any, is due to be filed on or before May 14, 2009.
The petitioner’s attorney is reminded to file her appearance.
