ORDER OF THE BOARD (by G. T. Girard):
On July 24, 1995, the Board received a motion filed by
petitioner asking the Board to consolidate this matter with PCB
95-78 vogue Tyre v. Office of State Fire Marshal or in the
alternative to assign the same hearing officer to both
proceedings. On August 4, 1995, the Board received a response
from the Illinois Environmental Protection Agency asking that the
Board deny the motion to consolidate. The Board notes that the
parties to the actions are not the same and the evidence which
may be submitted differs in the cases. Therefore the Board
denies the motion to consolidate.
The Board has already assigned both cases to the same
hearing officer for administrative efficiency.
