ORDER OF THE BOARD (by M. McFawn):

This matter is before the Board on a December 19, 1994

motion for extension of time in which to file recommendation

filed by the Illinois Environmental Protection Agency (Agency).

Pursuant to Section 104.180(a) of the Board’s procedural rules,

the Agency must file its recommendation in a variance proceeding

within 30 days of the filing of the petition. (35 Ill.

104,180(a).) Since the petition in this matter was filed on

November

15,

1994 the Agency’s recommendation was due December

15, 1994. The Agency seeks an extension until January 12, 1995.

In support of its motion, the Agency states that it needs

additional information in order to makes its recommendation, and

that additional time is needed in order to obtain such

information from petitioner. The Agency states that it met with

petitioner and requested such information on December 6, 1994.

The Agency further states that petitioner has agreed to the

requested extension.

The motion for extension of time to file the Agency

recommendation is granted. The recommendation is therefore due

January 12, 1995.
