ORDER OF THE BOARD (by E. Dunham):
This matter comes before the Board on an “Agreed Motion to
Stay All Actions on All Pending Motions” filed on July 15, 1994.
The complaint in this matter was filed on April 19, 1994.
Pending before the Board are complainant’s motion to strike
respondent’s affirmative defenses and respondent’s motion to
dismiss. The parties request that the Board stay action on the
pending motions because the parties have reached an agreement in
principle settling this matter. The parties state that they
expect to file a stipulation and settlement with the Board in the
near future. The Board notes that the motion for stay does not
specify a date for the expiration of the stay.
The motion for stay is granted. However, the Board does not
favor indefinite stays. Accordingly, the Board will grant the
stay for a period of 90 days. The stay will expire October 19,
1994, at which time the parties are directed to file a status
report.
