ORDER OF THE BOARD (by C.A. Manning):
On January 12, 1994, the North Shore School District #112
filed a petition for review of an Office of the Illinois State Fire
Marshal (“OSFM”) eligibility and deductibility determination to
access the Underground Storage Tank Fund. The OSFM issued a final
determination letter on December 13, 1993 pursuant to 57.9(c) of
the Act and the appeal was brought under Section 57.9(c) (2). (415
ILCS 5/57.9 (c) (1993).) On February 7, 1994, the North Shore School
District #112 filed a motion for dismissal of the appeal, stating
that the District was unable to recover heating oil tank receipts
demonstrating the tanks were in use after January 1, 1974.
The motion is granted; the docket in this matter is hereby
closed.
