ORDER OF THE BOARD (by H.

McFawn):

On December 27, 1994, the Illinois Environmental Protection

Agency (Agency) filed a motion for an extension until January 31,

1995 in which to file its recommendation in this matter. The

recommendation was due January 5,

1995. The Agency states that

additional time is needed to review the petition, meet with

petitioner, and prepare the recommendation. The Agency states

that petitioner agrees the extension will not

prejudice

petitioner’s rights. Petitioner has

filed a waiver of the

decision deadline until July 30, 1995.

The motion for

extension of time in which to file the Agency

recommendation is

hereby granted. The Agency recommendation is

now due January

31, 1995.
