    (Variance)
    ILLINOIS
    ENVIRONMENTAL
    PROTECTION AGENCY,
    Respondent.
ORDER OF THE BOARD (C.A. Manning):
This matter comes before the Board pursuant to an Ililinois
Environmental Protection Agency (“Agency”) Motion for Extension of
Time to File Agency Recommendation, filed February 2, 1994.
Counsel for the Agency represents in a motion and supporting
affidavit, that the Agency is currently reviewing the requested
variance petition and discussion regarding the variance and a
possible adjusted standard are ongoing. The motion and affidavit
indicate the recommendation was due January 31, 1994; however an
extension would allow the parties sufficient time to resolve this
case. The Agency states Ensign-Bickford has no objection to the
filing of the instant motion, and that petitioner has filed an open
    waiver.
The motion is hereby granted. The Agency is directed to file
the recommendation within 30 days after the hearing officer has
entered an order scheduling a hearing. The Agency recommendation
shall be filed with the Board at least 40 days prior to the
scheduled hearing date unless the parties otherwise agree.
    IT IS SO ORDERED.
