    ORDER OF THE BOARD (by B. Forcade):
    On June 24, 1993, Tolles Realty Company (Tolles) filed a
    petition for review of an Underground Storage Tank Reimbursement
    Determination for a site located in Madison County. This matter
    is accepted for hearing.
    This petition is filed pending the outcome of an appeal of
    an Administrative Order issued by the Office of the State Fire
    Marshal. (Pet. at 4.) Tolles contends that the result of the
    appeal will determine if the Environmental Protection Agency’s
    decision at issue was in error. (Pet. at 4.) Tolles also filed
    an open waiver of the decision deadline.
    The parties are ordered to file status reports to keep the
    Board informed of any change in the status of this case. The
    parties shall file a status report with the Board on or before
    December 30, 1993. subsequent status reports should be filed
    every six months thereafter or sooner if circumstances warrant.
    Based on the status reports the Board will set this matter for
    hearing or take other appropriate action.
