ORDER OF THE BOARD (by J. Anderson):
Pursuant to the Board’s order of June 17, 1993, a status
report was to be filed in this matter on or before August 25,
1993. On September 14, 1993, LTV filed a status report
accompanied by a motion for leave to file instanter and a waiver
of the decision deadline until March 7, 1994.
The motion for leave states that during the period
surrounding the August 25, 1993, due date for the status report
in this matter, petitioner LTV Steel Company was in the process
of emerging from bankruptcy. All of its legal personnel were
heavily involved in that effort and, as a result, the status
report filing date was overlooked. Petitioner’s local counsel,
Ross & Hardies, believed that Petitioner intended to file the
status report itself. The motion for leave is hereby granted.
The status report states that petitioner and respondent have
held a series of discussions concerning the inclusion of the
groundwater monitoring requirements in the permit that is the
subject of this appeal. Agreement has been nearly reached on
that issue and, provided that agreement is achieved, petitioner
will withdraw its appeal well before the requested decision date
of March 7, 1994.
Petitioner is directed to file an updated status report on
or before November 15, 1993, in the event that this appeal has
not previously been dismissed.
