ORDER OF THE BOARD (by E. Dunham):
On June 1, 1994,
petitioner filed a “Petition for Dismissal
of Red Oak LUST Fund Reimbursement Open Waiver”. Petitioner
represents that its reimbursement & deductibility application to
the LUST Fund was refiled under the newly structured OSFM
program. Petitioner states that the issues on this appeal have
been resolved and eligibility has been granted.
The Board construes the filing by petitioner as a motion to
withdraw the appeal before the Board. The Board grants the
motion and dismisses this matter. The docket in this matter is
hereby closed. The Board notes that if this filing was not
intended to dismiss this matter, petitioner may file a motion for
reconsideration pursuant to 35 Ill. Adm. Code 101.246.
IT IS SO ORDERED.
Section 4. of the Environmental Protection Act, (415 ILCS
5/41 (1992)), provides for appeal of final orders of the Board
within 35 days of the date
of service of this order. The Rules
of the
Supreme Court of Illinois establish filing requirements.
