ORDER OF THE BOARD (by C.A. Manning):
On September 8, 1993, the Knapheide Mfg. Co (“Knapheide”)
filed a petition for variance for its facility located in Quincy,
Illinois. The Knapheide Company has recently received a
provisional variance from the Board in PCB 93-141, July 29, 1993,
to allow it to move its operations from Missouri due to the
Mississippi flooding to Illinois. The Board in its opinion agreed
to expedite this proceeding.
Although the Board will expedite this matter, the petition
is deficient in that it fails to provide the supporting affidavit
as required pursuant to 35 Ill. Adm. Code 104.124. In addition,
the Board directs petitioners to address whether a hearing is
necessary in order to fulfill State Implementation Plan
requirements. Also, the information provided in the petition
concerning the economic hardship and compliance costs needs to be
more specific as required by 35 Ill. Adm. Code 104.121 (e)and(f).
Unless an amended petition is filed within 45 days of the
date of this order, curing the above-noted defect(s), this matter
will be subject to dismissal. The Board notes that for purposes
of calculation of the decision deadline pursuant to Section 38 of
the Act, the filing of an amended petition will restart the
Board’s 120 day deadline.
