ORDER OF THE BOARD (by M. Nardulli):
This matter is before the Board on a May 27, 1993, petition
filed by Griffin Service (petitioner or Griffin) for review of
the Agency’s denial of reimbursement for specific costs from the
Underground Storage Tank Fund. Petitioner has filed an open
waiver of the decision deadline in this matter.
On November 12, 1993, the Agency filed a motion for summary
judgment. On December 1, 1993, the Board received Griffin’s
motion for extension of time to respond to motion for summary
judgement. On January 6, 1994, the Board granted petitioner’s
motion for extension of time and directed Griffin to respond
within 21 days from the date of that order. On January 31, 1994,
petitioner filed a second motion for extension of time. Griffin
requests an extension of time until February 28, 1994, to respond
to the pending motion or to submit a stipulated agreement in
resolution of the matter. Griffin states that the Agency has no
objection to the extension.
The Board hereby grants petitioner’s motion for extension of
time to respond to motion for summary judgment. Petitioner’s
response must be received by the Board on or before February 28,
1994.
