ORDER OF THE BOARD (by R. C. Flemal):
On February 1, 1993 Southern California Chemical Company
(SCCC) filed a petition for review of the Illinois Environmental
Protection Agency’s modification of its RCRA closure plan. On
December 2, 1993 the Board directed the parties to file status
reports on or before January 10, 1994. SCCC filed its status
report on January 11, 1994. No status report has been received
from the Illinois Environmental Protection Agency (Agency). SCCC
states that on August 5, 1993 it submitted a comprehensive
closure and post-closure plan to the Agency, and requested a
meeting with Agency representatives regarding this appeal and the
plan. On August 25, 1993 SCCC wrote the Agency and again
requested a meeting with Agency representatives. SCCC reports
that it has received no response to its inquiries from the
Agency.
The Board orders the parties to submit another status report
on or before February 14, 1994. Should no response again be
received from the Agency, the parties should be prepared to
proceed to hearing in this matter.
