    ORDER
    OF
    THE
    BOARD (by J. Theodore Meyer):
    This matter is before the Board on its own motion. On March
    26,. 1993, petitioner H & H Towing-Phillips 66 (H & H) filed an
    open waiver of the decision deadline, and a motion to continue
    the March 31, 1993 hearing scheduled in this case. That motion
    stated that H & H and the Illinois Environmental Protection
    Agency (Agency) were engaged in on-going negotiations which may
    lead to a full resolution of this appeal. The March 31 hearing
    was cancelled. The record does not contain any updated
    information since that March 26 filing.
    The parties are directed to file a status report with the
    Board no later than December 3, 1993. That report shall indicate
    the status of negotiations between the parties, and include a
    projection as to the timing of further proceedings before the
    Board.
