ORDER OF THE BOARD (by J. Theodore Meyer):
This matter is before the Board on respondents Neil and
Janet Ostro’s June 17, 1992 motion for extension of time in which
to answer. The Ostros ask for an additional thirty days “from
the date the answer in this matter is due, in which to conduct a
thorough investigation prior to filing a responsive pleading.”
(Motion at 1.) The motion states that counsel for complainant
Lake County Forest Preserve District has agreed to a thirty day
extension.
The Board grants the motion for extension of time in part,
until July 7, 1992. The Board’s procedures state that a
respondent shall file any claim that a complaint is frivolous or
duplicitous within 14 days of service of the complaint, or shall
file any motion to dismiss within 14 days of service of the
complaint. (35 Ill.Adm.Code 103.124, 103.140(a); Duplicitous or
Frivolous Determination (June 8, 1989), RES 89-2.) The Ostros
are granted an extension of time to 14 days from the date of this
order. Any filing the Ostros may choose to make shall be
received at the Board’s Chicago office by July 7, 1992.
Finally, the Board notes that the Ostros filed a waiver of
any deadline for final Board action in this matter. The Board
points out that there is no decision deadline in enforcement
cases.
