ORDER OF THE BOARD (by C. A. Manning):

In accordance with the Board’s order of April 22, 1993, the

parties each filed a status report; Safety-Kleen filed a report

on July 29, and the Agency filed a report on August 2. The two

reports are in general agreement. As the Agency’s report is more

detailed, its content will be relayed in this order.

The Agency’s report states that Safety-Kleen and the Agency

are currently finalizing the form of the revised closure plan

approval letter in this matter. The Agency has exchanged drafts

of the revised closure plan approval letter with Safety—Kleen on

or about June 25, 1993, July 15, 1993, July 23, 1993 and July 28,

1993. The Agency is currently awaiting comments regarding the

letter from Safety-Kleen’s technical staff.

The Agency states that if Safety-Kleen has no comments

regarding the latest draft, the Agency will be ready to issue the

letter. If Safety-Kleen has additional comments on the draft of

the closure plan approval letter, the Agency anticipates that the

comments will be quickly addressed and that Safety—Kleen and the

Agency will reach an agreement on the revised closure plan

approval letter in a very short time.

The Agency opines that once Safety-Kleen and the Agency have

reached an agreement on the revised closure plan approval letter,

all of the points of dispute in the permit appeal should be

resolved, placing Safety-Kleen in a position to voluntarily

withdraw this appeal.

Safety-Kleen states that the parties agree to file another

status report within 30 days. Accordingly, the parties are

directed to file an updated status report on or before September

7, 1993 in the event that this action has not previously been

dismissed.
