ORDER OF
THE
BOARD (by J. C. Marlin):
On January 15, 1993, the parties filed a joint status report
in accordance with the Board’s order of December 17, 1992. They
report that on December 11, 1992, they met to discuss a resolution
of the issues in this closure appeal.
As
a result of their
meeting, the parties have developed a conceptual agreement for
resolution of this matter and similar closure appeals at other
Safety-Kleen facilities in Illinois.
At
this time, the Agency is
finalizing the form of the submittals the Agency would like Safety—
Kleen to make to document the implementation of the agreement
reached between the parties~.
Once the Agency has finalized the format of the documentation
it will require, the parties will be in a position to resolve this
matter and Safety-Kleen will voluntarily withdraw this appeal. The
parties also plan to use the same framework
and
forms of documents
to resolve the pending closure appeals for Safety—Keeln’s
Schauinburg Facility (PCB 92-136) and the Arlington Heights Facility
(PCB 92-126). The parties anticipate that the Agency will finalize
the documentation format for submitta.s it will require within the
next several weeks. The parties intend to file another status
report within 30 days.
The parties are directed to file an updated status report on
or before February 20, 1993.
