ORDER OF THE BOARD (by J. C. Marlin):
On January 15, 1993, the parties filed a joint status report
in accordance with the Board’s order of December 17, 1992. They
report that after a series of discussions, .Safety—Kleen and the
Agency reached agreement on how to resolve all of the issues raised
in the above-captioned appeal. In order to memorialize the
understandings of the parties and to resolve the disputed permit
conditions giving rise to this appeal, the Agency asked Safety—
Kleen to submit a modified permit application. During October,
1992 Safety-Kleen did so. The application incorporated changesand
information supporting the understandings of the parties.
The parties state that the revised permit application is now
under review by the Agency for development of a modified permit.
The Agency anticipates that that permit will be issued within the
next several weeks. Once the permit is issued, Safety—Kleen
anticipates filing a motion to voluntarily withdraw this appeal.
The parties are directed to file an updated status report on
or before April 16, 1993 in the event this appeal has not been
dismissed.
