ORDER OF THE BOARD (by G.T. Girard):
Pursuant to the Board’s Order of June 15, 1992, petitioner
filed a status report on June 15, 1992. R. Lavin states that it
has been conducting a storniwater study of the stormwater discharges
from its plant in order to ascertain whether the parties would be
able to reach an agreement with regard to the issues raised in this
permit appeal. However, R. Lavin reports that the unusually dry
spring has made it difficult to complete the study as envisioned by
the parties.
The parties are trying to schedule a meeting for late June to
discuss the status of the stormwater study and other issues between
the parties unrelated to this appeal. If the site has not
experienced significant rainfall by that time, R. Lavin & Sons is
considering extending the stormwater study until such time as there
have been sufficient rain events to provide representative data for
analysis of the stormwater discharges from the site. Accordingly,
R. Lavin & Sons, Inc. suggests that the Board set this matter for
another status report in approximately 90 days.
The Board accepts the parties suggestion, and directs that a
status report be filed on or before September 15, 1992. The report
shall include an estimated date for the completion of this action.
