ORDER OF THE BOARD (by G.T. Girard):
On July 15, 1992, Olin filed a status report as directed by
the Board’s order of June 23, 1992. Olin states that it is
submitting this report alone, after unsuccessful attempts to
consult with the Agency. Olin reports that the parties have
continued to pursue settlement of this matter, and that they have
agreed on a basis for resolving the issues involved in this appeal~.
On July 1, 1992, Olin submitted to IEPA a modified closure plan
with respect to three units involved in this appeal. The Agency is
currently reviewing the plans. Olin reports that the parties have
agreed upon the elements to be included in the closure/post closure
plan, but the details are subject to review and approval by IEPA.

reasonably confident that they will agree on plan conditions which
will lead to IEPA approval of the modified closure/post closure
plan. Upon approval of the modified closure/Post closure plan,
Olin will move for the dismissal of this appeal.
On July 23, 1992, the Agency filed a status report accompanied
by a motion for leave to file instanter. The Agency states that it
concurs with Olin’s report, and that its failure to timely file a
status report is due to vacation leave taken by counsel, and press
of other business. The Agency’s motion for leave to file instanter
is granted.
To insure that this matter be resolved as expeditiously as
practicable, the Board directs the parties to file another status
report with the Board to be received by the Board no later than
November 1, 1992.
