ORDER OF THE BOARD (by G.T. Girard):
On June 15, 1992, the parties filed a status report as
directed by the Board’s order of April 9, 1992. The parties report
that they have continued to pursue settlement of this matter, and
that they have agreed on a basis for resolving the issues involved
in this appeal. By July 1, 1992, Olin will submit to IEPA a
modified closure plan with respect to three units involved in this
appeal. This date reflects a one month extension of the previously
agreed—upon submittal date. The extension was agreed upon to allow
Olin the opportunity to install piezometers at the site in order to
establish the direction of groundwater flow and select proposed
monitoring well locations. The parties have agreed upon the
elements to be included in the closure/post closure plan, but the
details are subject to review and approval by IEPA and the U.S.
Environmental Protection Agency. The parties are reasonably
confident that they will agree on plan conditions which will lead
to IEPA approval of the modified closure/post closure plan. Upon
approval of the modified clOsure/post closure plan, Olin will move
for the dismissal of this appeal.
To insure that this matter be resolved as expeditiously as
praOticable, the Board directs the parties to file another status
report with the Board to be received by the Board no later than
July 15, 1992.
