ORDER OF THE BOARD (by J. C. Marlin):
This matter is before the Board on the parties’ March 16, 1992
agreed motion to hold this permit appeal in abeyance. The parties
state that the sole remaining issue in this Permit Appeal is the
thermal limitations required by the Draft Permit. LTV has agreed
to perform a thermal study of a section of the Calumet River, in
conjunction with Acme Steel Company, a neighboring steel facility
that has a similar permit appeal pending before the Board. LTV
asserts that the results• of the thermal study will provide the
basis for an adjusted standard petition that LTV and Acme Steel
intend to file to adjust the thermal limitations currently set in
their Permits that are on appeal. LTV Steel moves the Board to
hold this permit appeal in abeyance pending the outcome of the
thermal study and the outcome of the adjusted standard. Finally,
LTV states that should the “third airport” be developed in the
proposed Lake Calumet area, the facility that is the subject of
this appeal would probably be demolished, rendering this appeal
moot.
The Board notes that, while decision in this matter is
currently due on September 1, 1992, LTV apparently seeks an
indefinite “stay” of this permit appeal. The Board will
accordingly construe LTV’s motion as a motion for stay. The Board
will not grant this request, particularly since the motion contains
no detail concerning LTV’s projected timetable for completion of
its thermal study; the Board has an obligation to bring permit
appeals to a timely resolution. The Board will, however, stay this
proceeding for a 60-day period, through May 25, 1992, at which time
the parties are directed to file a status report. In the event the
parties wish to seek an additional stay, any motion must be
accompanied by an appropriate waiver of the Board’s decision
deadline and information sufficient to allow the Board to determine
the anticipated date for conclusion of this action.
