ORDER OF THE BOARD

Marlin):
This matter comes before the Board on receipt of an Agency
Recommendation dated August 7, 1990. The recommendation refers
to a request from Petitioner, Granite City Division of National
Steel Corp. for a 15—day provisional variance from the visible
and particulate matter emissions limitations for by-product coke
plant quenching, as set forth in 35 Iii. Adm. Code 212.443(h),
for the period from August 6, 1990 to August 21, 1990.
Upon receipt of the request, the Agency issued its
recommendation, concluding that failure to grant the requested
15—day provisional variance would impose an arbitrary or
unreasonable hardship on Petitioner. The Agency recommends that
the Board grant the requested relief with conditions. The Agency
also asserted that there is no reasonable alternative for
compliance and that the Petitioner has not received provisional
variance relief this year to date. The Agency maintains that no
adverse environmental impact will occur as a result of a grant of
this provisional variance.
In light of the Agency Recommendation, the Board hereby
grants a provisional variance from 35 Ill. Mm. Code 212.443(h)
from August 6, 1990 to August 21, 1990, subject to the following
conditions:
1. The Petitioner shall spray roadways adjacent to the
West Quench Tower, as indicated on the attached map (Exhibit
1), twice daily during the term of this provisional
variance;
2. The Petitioner shall report to the Agency the date it
commences repairs to its West Quench Tower and the date it
completes those repairs;
3. The Petitioner shall report to the Agency the dates it
sprays the roadways adjacent its West Quench Tower and the
times and amounts of surfactant utilized; and

4. The Petitioner shall submit all reports required under
this provisional variance to the Agency no later than August
24, 1990, addressed as follows:
