CONCURRING STATEMENT (by J.D. Dumelle):
My reason for concurring is that I feel the stipulated
penalty is far too low. Not only is it $167 per year of
violation but since 11 pieces of equipment are involved it is
only $15 per piece of equipment per year!
In the past the Board has usually assessed a penalty of $500
to $1,000 per piece of equipment per year of violation.
Obviously if that were done here the total would be much higher
than the $3,000 penalty submitted.
I would have rejected the stipulation as clearly inadequate.
