    ORDER OF THE BOARD (by J. C. Marlin):
    On November 5, 1990 the Complainant filed this matter with
    the Board. The Respondent has not addressed the issue as to
    whether this complaint is duplicitous or frivolous pursuant to
    Section 31(b) of the environmental Protection Act. (Ill. Rev.
    Stat. 1989, ch. 111 1/2, par. 1031). The Board accepts this case
    for hearing. A Hearing Officer will be assigned to this matter
    who will contact the parties and set this matter for hearing.
