ORDER OF THE BOARD (by J. Anderson):
On April 21, 1988, Olin Chemicals (Olin) filed a petition
for variance that is informationally deficient in a number of
respects, including:
The petition lacks a compliance plan; reliance on a
successful outcome of a yet to be filed site—specific rule
change is insufficient. Also, the petition is generally
deficient in that it lacks the applicable information
required by the Board’s procedural rule 35 Ill. Adm. Code
104.121.
The petition must also indicate whether the Board may grant
the requested relief consistent with federal law. See the
Board’s procedural rules 35 Ill. Adm. Code 104.122(a) and
(d).
Unless an amended petition is filed within 45 days of the
date of this Order, curing the above—noted defects, this matter
will be subject to dismissal.
