ORDER OF THE BOARD (by J. Anderson):
This matter is before the Board on its own motion. On
August 27, 1990, Braidwood filed a Motion for Reconsideration.
The motion comes in response to the Board’s June 21, 1990 Opinion
and Order, denying the City of Braidwood’s (“Braidwood”) request
for variance from 35 Iii. Adm. Code 602.105(a), “Standards for
Issuance”, and 35 Ill. Adm. Code 602.106(b), “Restricted Status”.
In the motion, Braidwood states that it filed a “Motion for
Leave to File Supplemental Petition” and a “Supplemental Petition
to First Amended Petition” with the Hearing Officer at the April
25, 1990 hearing. Undated copies of both documents are attached
to the motion and are marked as Exhibits A and B, respectively.
The Board has reviewed the Clerk’s docket sheet and file in
this case. There is no indication that either document was ever
filed with the Clerk. There is also no mention of either
document in the hearing transcript. In order for the Board to
have complete file and understanding of the history of the case,
the Board requests that the parties and hearing officer submit
any information that they may have regarding the documents and,
if possible, the original documents themselves. The information
and/or documents should be filed with the Board on or before
September 14, 1990.
