ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon a December 21, 1989,
Petition for Variance filed by the City of Braidwood
(Braidwood). The Board finds that this petition does not
completely satisfy the requirements of the Board’s procedural
rules set forth in 35 Iii. Adm. Code 104. In particular, the
Board notes that the petition does not include a hearing request
or waiver as required by Section 104.124. Also, the petition
references a Letter of Commitment sent to the Illinois
Environmental Protection Agency (Agency) as part of Braidwood’s
proposed compliance plan. The Board requests that said Letter of
Commitment be made part of the record in this proceeding.
If an amended petition is not filed within 45 days of the
date of this Order, this petition will be subject to dismissal.
