ORDER OF THE BOARD (by J. Theodore Meyer):
This matter is before the Board on a motion filed by
respondent the County of McLean (County) on July 24, 1989. The
County asks that the Board incorporate the entire common law
record and transcript from Board docket PCB 87—133 into the
record of this proceeding. The County states that the decision
of the McLean County Board was based upon the common law record
and transcript previously filed in PCB 87—133; that only eight
new documents have been added to the common law record since the
Board issued its May 25, 1989 order remanding PCB 87—133 to the
McLean County Board; that the eight new documents and a
certificate of record have been filed in this proceeding (PCB 89—
109); and that it would be duplicative for the County to resubmit
and cumbersome for the Board to accept identical copies of the
common law record and transcripts previously filed in PCB 87—
133. The County states that petitioner McLean County Disposal
Company, Inc. has no objection to and concurs in this motion.
The County’s motion is granted. The common law record and
the transcripts from PCB 87—133 are hereby incorporated into the
record of this proceeding.
Additionally, the Board notes that
it
received the $75
filing fee from petitioner on July 20, 1989. The 120—day
statutory decision period thus began on July 20, 1989.
