ORDER OF THE BOARD (by 3. Anderson):
By Board Order of January 5, 1989, the Board directed
Marathon Petroleum Company (Marathon) and the Illinois
Environmental Protection Agency (Agency) to advise it of the
status of documents labelled Confidential in Exhibit L filed in
the Agency Record in this RCRA permit appeal.
On January 18, 1989, the Agency filed a Statement of
Respondent concerning the Status of Documents included in Exhibit
L of Administrative Record of Final Permit. On January 17, 1989,
Marathon filed a Response By Marathon Petroleum Company to the
Board’s Order Entered January 5, 1989.
Marathon’s response states that it has no objection to
placing in the public inspection files the documents in Exhibit L
which were previously rendered confidential. In the Agency’s
statement it questions the exclusion, on a confidentiality basis,
of pages 4747 through 4791 of Exhibit L but does not request that
pages 4792 through 4930 of Exhibit L be excluded from the Board’s
public inspection files. Since both Marathon and the Agency
essentially agree that the documents in Exhibit L are not
confidential, the Board will not afford them trade secret
protection.
Therefore, the Board directs the Clerk to place
Exhibit L into the public inspection files.
