ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon reciept of the
Illinois Protection Agency’s Agency Recommendation dated
September 7, 1988. The Recommendation sets forth the relevant
data as set forth below.
On August 26, 1988 the Agency received Petitioner’s request
for extension of the 90—day on—site storage limitation for
hazardous waste set forth at 35 Ill. Mm. Code 722.134(b). The
Petitioner avers that unforseen, temporary and unforseeable
circumstances necessitate that an extension be granted; and that
under the circumstances it would create an arbitary and
unreasonable hardship if such an extension were not granted.
The Illinois Protection Agency concurs, recommending that
Petitioner be granted the requested extension pursuant to 35 Ill.
Mm. Code 722.134(b) until September 26, 1988.
The requested provisional variance is granted until
September 26, 1988.
