ORDER OF THE BOARD (by J.D. Dumelle)
This matter comes before the Board upon receipt of an Agency
Recommendation filed stamped on August 8, 1988 on behalf of the
Illinois Environmental Protection Agency (Agency).
On June 28, 1988 the Agency received a request for
provisional variance from Stewart—Warner Corporation requesting a
30—day extension of the 90—day limit for on—site storage of
hazardous wastes set forth at 35 Ill. Adm. Code 722.134(b).
Upon reviewing the request the Agency found that the
necessity of allowing the hazardous waste to remain on—site was
due to unforseen, temporary and uncontrollable circumstances and
failure to grant the requested provisional variance would impose
an arbitrary or unreasonable hardship.
The Board concurs; and does hereby grant to Stewart—Warner
Corporation a provisional variance from the provisions of 35 Ill.
Adm. Code 722.134(b) from June 28, 1988 to July 27, 1988.
IT IS SO ORDERED.
