ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon the June 13, 1988,
Petition For Variance filed by the Village of Orarigeville by
Village President J. Milton Bostian. The Petition is dismissed.
The Petition is def~icientbecause it fails to comply with
the requirements of 35 Ill. Adm. Code 104.121. But more
importantly, the Petition is dismissed because, although
captioned as a Request For Variance, the Petition is in reality a
request for permanent relief from several regulations of general
applicability. A request for rule change is not the same thing
as a variance; the standards are different and the proofs
required are different.
Accordingly, for the foregoing reasons, this action is
dismissed and the docket is closed.
