ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon the June 2, 1988
Petition For Review Of Special Waste Determination, filed by the
Village of Western Springs.
The Petition notes that on July 9, 1987 and April 28, 1988
the Agency denied Western Spring’s Petition to declassify calcium
carbonate pellets as a special waste. The Board notes that the
current Petition is timely filed as to the most recent request
but not as to the former request. The current Petition does not
state whether these are the same or separate requests.
Therefore, the Board orders the parties to brief no later
than July 6, 1988 the issue of whether the failure to appeal the
July 9, 1987 request bars this Board’s review concerning the
April 28, 1988 request. Likewise the parties are further ordered
to brief the issue of standards for determining whether or not a
special waste should be delisted.
