ORDER OF THE BOARD (by J. Anderson):
This petition for variance from the restricted status rules
as they relate to the fluoride drinking water standard, filed on
May 3, 1988, is deficient in one respect. The petition presents
two alternative compliance plans, one of which would involve
actions to be taken by Turnberry Utilities, Inc. The Board finds
that a complete determination concerning this petition cannot be
made in this matter unless Turnberry is made a party.
Accordingly, pursuant to Section 103.121(c) of the Board’s
procedural rules, McIntosh must file an amended petition which
joins Turnberry either as a co—petitioner or as a respondent as
well as proof of service of that petition on Turnberry as
directed by Section l03..l23.
If an amended petition curing this deficiency is not filed
within 45 days of the date of this Order, this petition will be
subject to dismissal.
