ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon receipt of an Agency
recommendation for provisional variance; the recommendation was
filed October 19, 1988.
The recommendation concerns a request by Crescent Plating
Works, Inc., to allow on—site storage of hazardous waste beyond
the 90—day limit imposed by 35 Ill. Ac3m. Code 722.134(a).
The Agency has concluded that the necessity for the
hazardous waste to remain on—site was due to unforeseen,
temporary and uncontrollable circumstances; and that failure to
grant the requested provisional variance would impose an
arbitrary and unreasonable hardship on Petitioner. The Agency
urges this Board to grant the requested provisional variance.
The Board does hereby grant provisional variance to Cresent
Plating Works, Inc., to allow on—site storage of hazardous wastes
from September 28, 1988 until October 28, 1988.
