DISSENTING STATEMENT (by J.D. Dumelle):
This permit appeal was filed with the Board on July 26,
1988. That date was 2 years and one month ago and still the case
is not yet ready for decision.
This Board has been repeatedly criticized by USEPA for
taking too long a time to decide pending matters. Yet it has let
this case drag on for 25 months.
The August 29, 1990 motion describes four separate filings
of permit modifications and closure plans with IEPA. To me that
shows that Laclede Steel Co. is actively pursuing a revision to
the same matter here before us in another forum, that o~the
IEPA. Our longstanding doctrine holds that the instant case
should be dismissed and I would have done so.
Repeated rescheduling of hearings that are never held only
wastes precious taxpayers money for legal notices.
For these reasons, I dissent.
