ORDER OF THE BOARD (by J.D. Durnelle):

This matter comes before the Board upon Petitioner’s January

20, 1988 filing of a Response To Board Order. Petitioner

initially filed a Petition For Variance on November 30, 1987. On

December 3, 1987 the Board ordered Petitioner to tender more

information regarding a compliance plan; and to brief issues

raised by Petitioner’s challenge of the validity of the

regulations.

Petitioner has failed to brief issues raised by its

challenge of the regulations.

Petitioner is given 10 days from the date of this Order to

comply with the December 3, 1987 directive concerning the

briefing of issues raised by Petitioner’s challenge of the

regulations. If Petitioner does not comply, the Board shall

consider appropriate action, including barring of evidence

related to these issues.
