ORDER OF THE BOARD (by J.D. Dumelle):

This matter comes before the Board upon Respondent’s

February 23, 1988 appeal of a Hearing Officer Order (dated

February 16, 1988). Petitioner responded by Motion on February

25, 1988.

Respondent’s appeal of the Hearing Officer’s Order is

denied. The Hearing Officer’s Order specifically allows the

Agency to seek protection and sanctions from the Hearing Officer

if the need should arise.

Accordingly, Respondent’s Motion is denied.
