INTERIM ORDER OF THE BOARD:

This matter comes before the Board upon an August 11, 1987

filing of a petition for review to contest the issuance of an

Administrative Citation filed July 16, 1987, pursuant to Section

31.1 of the Illinois Environmental Protection Act (Act) by the

Respondents Paul and Joan Corley. By Order of October 1, 1987,

the Board gave the Agency leave to file an amended administrative

citation in light of the Board’s ruling in Illinois Environmental

Protection Agency v. James Pressnall, AC 87—6, September 17,

1987, that under Section 31.1 of the Act only permitted sanitary

landfill operations are subject to Administrative Citation

enforcement.

On October 14, 1987, the Agency moved for stay of the

October 1, 1987, Order, citing its intention to file a motion to

vacate or modify the Pressnall decision on or before October 22,

1987.

At this time the Board will grant a limited stay of its

Order, and will allow the Agency to make any supplementary filing

on or before November 13, 1987. In the event the Board does not

take action on Pressnall on October 29, 1987, a further stay will

be considered.
