ORDER OF THE BOARD (by B. Forcade):
On January 21,1988, General Tire filed a motion for
reconsideration of the Board’s December 17, 1987, Opinion and
Order in this matter. General Tire also requests that the Board
postpone ruling on the motion to reconsider pending the filing of
additional materials. General Tire asserts that it is meeting
with the Illinois Environmental Protection Agency (“Agency”) in
an attempt to resolve certain disagreements. On February 25,
1988, the Agency filed a response agreeing that disposition of
the motion for reconsideration should be postponed until the
parties can explore the issues involved.
The Board will deny the motion for reconsideration. Any new
factual information would be more appropriately filed as a new
variance petition. General Tire is, of course, free to file a
variance petition at any time.
