    ORDER OF THE BOARD (by J. Theodore Meyer):
    This matter comes before the Board upon a June 27, 1986
    Illinois Department of Transportation request for approval of a
    permit for the Waukegan Port District’s (Waukegan) project which
    includes the replacement of the failing dockage system in the
    existing Waukegan Harbor and expansion of the dockage system into
    part of the area currently used for moorings. The Board finds
    the permit application deficient and requests that Waukegan
    submit more information on the following matters:
    1. The application states that approximately 2900 cubic
    yards of dredged material is to be disposed of at the
    “Airport disposal site.” Please identify this site,
    specifically location and the scope of its present
    operations, including whether the proposed disposal is
    included with in the scope of the site’s presently
    permitted operations.
    2. The application also states that the excavated area will
    be “restored by filling with inert materials from future
    building foundations.” What will be the composition of
    this material and will any contamination of Lake
    Michigan and Waukegan Harbor occur?
    3. Finally, the application states that the supernatant
    will be pumped out of the scow into the Waukegan
    harbor. Will this effluent violate any water quality or
    effluent standards applicable to Lake Michigan? And, if
    so, does the plan contemplate treatment of this effluent
    to meet applicable state standards?
    4. Will the operation of the scow require a permit issued
    by the Illinois Environmental Protection Agency?
    5. Should the Army Corps of Engineers be made a party to
    this proceeding?
    6. Has the project contemplated in this permit application
    already commenced? If so, provide details.
