ORDER OF THE BOARD (by 3. Marlin):
On May 22, 1986, the Village of Pawnee (“Village”) filed a
petition for variance requesting relief “from the rules,
regulations and requirements relating to normal operation of its
treatment plant” during upcoming construction at its sewage
treatment plant (Petition at 2).
The petition, however, fails to address the requirements of
35 Ill. Adm. Code 104.121, 104.122 and 104.124, including the
following:
1) identify the regulations of the Board from which relief
is sought biochemical oxygen demand and total suspended
solids effluent standards for a plant with a three stage
lagoon exemption are at 35 Ill. Adm. Code 304.120(a);
2) identify any alternative methods studied to obtain
compliance and the relative costs;
3) identify the cost of the project as proposed;
4) assess the environmental impact of the proposed project
on the environment;
5) state whether the Board may grant the requested relief
pursuant to federal law (Clean Water Act, 33 U.S.C.
1251 et seq.)
6) submit an affidavit attesting to the truth of the
matters asserted in the petition when waiving the
hearing requirement.
Unless the Village files an amended petition curing the
above defects within 45 days of the date of this Order, the
petition will be subject to dismissal.
