ORDER OF THE BOARD (by B. C. Flenial):
On March 16, 1987, Petitioner Wells Manufacturing Company
(“Wells”) filed a motion which requests that the Board reconsider
its March 5, 1987, Order upholding the decision of the Illinois
Environmental Protection Agency (“Agency”) to deny Wells’
application for an air operating permit. Wells appears to
contend, in support of its motion, that its periit application
before the Agency was denied “without affording (Wells) the
opportunity to be heard...(in) violation of Wells’ right to due
process of law”.
On March 31, 1987, the Agency, as represented by the State’s
Attorney of Cook County and the Attorney General for the State of
Illinois, filed two responses in opposition to Petitioner’s
Motion for Reconsideration.
The Board does not believe that Petitioner’s due process
rights have been violated. Accordingly, Wells’ March 16, 1987,
motion is denied.
