ORDER OF THE BOARD (by J. Anderson):
On December 23, 1987, attorneys for Forest Electric filed
motions to appear for rehearing, and for production of the record
to aid them in preparation for rehearing. On December 29, 1987,
the Agency filed a response opposing only the motion for
rehearing.
The motion for leave to appear is granted. The motion for
rehearing is denied. As the Agency notes, Forest Electric made a
business decision to have a corporate officer, rather than an
attorney, represent it in this case prior to the Board’s decision
adverse to Forest. While Forest ~may have made a tactical error,
the Board finds no legal error in this case which merits
rehearing. Given this finding the motion for production ofthe
record is also denied. The Board notes that, as is the case in
all matters before the Board, the complete record is available
for public inspection and copying (upon payment of copying
costs); arrangements therefore can be made by contacting the
Clerk of the Board.
