ORDER CF THE BOARD (by J.D. Durnelle):
On December 8, 1986, the Village of Elizabethtown filed
additional information with the Board in response to the Illinois
Environmental Protection Agency’s (Agency) Recommendation. The
Board construes the filing by the Village as an amended petition
for variance for which the Environmental Protection Act has
established a decision deadline of 120 days absent a waiver of
decision date by petitioner. Therefore, decision by the Board on
this amended petition has been scheduled for the Board’s
regularly scheduled Board meeting on April 2, 1987. The Agency
is free to file an amended recommendation upon a review of this
additional information should it so choose.
