CONCURRING OPINION (by J. Marlin):
I supported the Order and Opinion denying Chanute’s prior
variance request in PCB 84—24. While the current request is
similar, the facts have changed enough that I will not dissent
from granting this variance.
In the prior proceeding, Chanute sought relief from
standards which would essentially allow it to shut down its
Calgon treatment facility. At the present time, that facility is
not functioning apparently because it needs replacement parts.
The discussion of the Calgon facility is sketchy at best. The
petitioner has not bothered to inform the Board when the unit was
shut down or give any details as to why it was shut down.
However, the information provided as a whole is superior to that
of the prior variance. In many ways, the hardship in this
situation is self imposed. There is a long history of
operational problems and certain decisions which were clearly not
optimal.
I am supporting this variance mainly because Chanute will be
connecting to a regional treatment plant during the coming
year. It would make no sense to attempt to repair the existing
system given that it would take at least six months to obtain and
install the necessary equipment which would be rendered obsolete
after only a few months use, particularly given the minimal
environmental impact expected during the variance period.
