EXCEPTION TO THE COMBINED SEVER
OVERFLOW REGULATIONS
ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon a January 6, 1986
Petition for Exception to the Combined Sewer Overflow Regulations
fi~led on behalf of the City of Effingham (City). The Board finds
that had the petition been properly addressed to the Board’s new
offices, then it would have been timely filed and therefore, the
Board will accept the petition. However, the Board finds that
the petition is deficient in several areas.
Specifically, the City should submit more information on the
requested relief. The City should specify the presently
applicable standards, which of those standards it believes should
be found inappropriate and what substitute standards should be
imposed, if any. Further, the City should submit additional
information concerning the environmental impact of the combined
sewer overflows and whether any enforcement action has been
initiated against the City or if there has been any non-
compliance with variances granted to the City.
Unless this additional information is filed within 45 days
of this Order, this matter is subject to dismissal.
