ORDER OF THE BOARD (by Cl. Anderson):
On August 23, i985~Hanley filed an amendment to its August
20 variance petition, requesting a hearing. This amendment does
not address the other informational deficiencies noted by the
Board in its august 2:L Order, as it does not:
a) specify the procedures to be used during burns, such as
operating protocol, safety and emergency procedures, and
atmospheric conditions during which burns would be
conducted;
b) contain details concerning the costs and availability of
alternative disposal ootions;
c)
contain comp:Liance p:L~iri
other than
an
indicated intent
to ask for an extension of variance next year. The
En~iironmentai Protection
Act contemplates that variance
will lead to
com~i:iance; if Hanley wishes to continue
open burning
through
the
indefinite future, a petition
for si~e~specificrule change might be the more
appropriate procedural mechanism.
By the terms of the August 21 Orders if an amended petition
curing these deficionc~esis not filed on or before October 7,
1985, this petition will be scbject to dismissal. Hearing will
not be scheduled in this matter until the Board receives an
amended petition~
