OPINION (by J~ Marlin):
The Village received my concurring vote in this case only
because denial would most likely delay resolution of
the
issue
even further into the futures The Village did essentially
nothing to investigate compliance alternatives prior to
applying
for the variance extensions It did not determine the
barium
level of well 3~ It did not even seek the
assistance of the
Illinois State Geological Survey until l985~
However, I agree
with the majority that leaving the Village open to
enforcement at
this point in time will not necessarily contribute
to a desirable
resolutions
